Wasaga Beach town councillor Rick Archdekin is suing the town, and the owner of Wasaga Sands Golf Club.
He has filed a civil suit against the town and the golf club over access to their property.
The owner of the golf course, Roger Gray, is also the husband of town councillor Connie Gray.
The suit comes after an ongoing disagreement between Archdekin and Gray over the access to a driveway on Archdekin’s property.
Archdekin has been using a piece of land to access their garage since purchasing their home, and wants the road on the land to be declared an open and public highway.
He tells Bayshore Broadcasting News that they don’t like the situation they’re in right now, and just want a resolution.
But Gray says that when they purchased the course back in 2007, the piece of land in question came with it.
The case will be in front of the Ontario Superior Court of Justice in Barrie on May 14th.
The land in question now has a truck, and piles of dirt on it, blocking access to the driveway.
The Archdekin’s suit says that they have accessed their driveway using the piece of land since they bought the house, and that the town has maintained it as well.
Gray says the previous owner already had water and sewer put in, to eventually sever the land off as a lot, but never got around to it.
He says that when they first went out to look at the land after buying it, Councillor Archdekin came out and told them that he had been using the land for a while, and that if they were going to do anything with it, he would claim squatters rights.
Gray says that land titles that were put on the property before the house was built, and that the town doesn’t have the authority to claim the land as a road, which is why the fight is going before a judge.
He says if the judge doesn’t warrant the land in question a road, Archdekin has also asked for an easement.
But Gray says that the land titles put on his property back in the 70’s should prevent that from happening as well.
He says that he bought the land, and can do with it what he sees fit, and believes that Archdekin is trying to get a free piece of land off of them.
Gray he’s being made out to be the bad guy, and adds that they have offered Archdekin a few different deals, one of which included 5 feet off of the piece of land to build a new driveway.
But he says that the offers were shot down, and Gray believes Archdekin wants to get the whole plot of land.
He says there’s no chance of an amicable solution now that the case is headed to court, but adds that he’s confident, because of the land titles on his property, and the fact that there is no record of the land being deeded or transferred to the town.
Gray says it would be tough for a judge to vote against land titles, but quickly adds you never know what a judge will say.
He says that the case’s argument is pretty weak, but they’ll find out in court on May 14th.
Gray stresses that councillor Archdekin is nothing but professional, and so is his wife, councillor Connie Gray.
He says that both councillors sit beside each other at council, and there are no issues there.
