The fate of Anthony Terpstra and Serena Benninger on charges of counselling and conspiracy to commit murder is now in the hands of the jury at Goderich Court.
On Tuesday morning — Justice John McGarry spent more than an hour instructing the eight-woman, four-man jury.
He told the jury the conspiracy charges will be complicated because the jury has to find both co-accused guilty beyond reasonable doubt.
Justice McGarry says if they find one is not guilty then the other cannot be convicted on the same charge.
He says the evidence and testimony must point to a firm agreement to kill Terpstra’s wife because intention or pretence won’t be enough to convict the North Huron residents.
