Ontario’s Special Investigations Unit (SIU) isn’t laying charges in the case of an elderly man, who, it was claimed, suffered a fractured rib and vertebra during an encounter with police in Penetanguishene.
On November 11th, the 76-year-old man was arrested under the trespass to property law after refusing to leave an apartment after repeated requests.
It was alleged he was kicked in the back while in the apartment and then pushed to the floor, but SIU Director Joseph Martino has ruled the two responding officers did nothing to cause the man’s injuries when they arrested him.
“I am satisfied that the officers did nothing to cause the Complainant’s injuries,” writes Martino. “Their physical interventions consisted of reaching out to take hold of the Complainant in order to arrest him, whereupon he immediately fell to the ground, followed by the application of the handcuffs, which on all the evidence was done without incident.”
