An update to the story of three boys who were hit by a car as they rode their bikes down a country road south of Barrie in the fall of 2012 — there are now duelling lawsuits after the deadly crash.
The families of the boys who were hit are suing the woman who hit them.
But, the woman driving the SUV is also suing, looking for 1.35 million dollars for her pain and suffering.
The National Post reports Sharlene Simon is suing the estate of Brandon Majewski and is also suing the two boys were were with him the night he was killed.
One of them spent weeks in hospital recovering from his injuries.
Simon claims claims loss of enjoyment of life, pain and suffering after the crash.
She was not physically injured.
The lawsuit claims the boys were at fault in the crash, since they weren’t wearing reflective gear and were riding in the dark, three across, when they were run down.
No charges were ever laid against Simon, and a police report into the crash says it was the boys’ lack of visibility that led to their deaths.
A $900,000 lawsuit has also been brought by the families of the boys against Simon and her husband and the County of Simcoe.
