A Shelburne family could be headed back to court.
The family can again pick up its lawsuit against the province for alleged negligence by an ambulance worker.
The Ontario Court of Appeal has overturned a Superior Court decision that had struck down the claim.
It was launched by the family of 17-year-old Patrick Heaslip, who was seriously injured in a tobogganing accident in February 2005.
An emergency room doctor in Alliston called for an air ambulance but a dispatcher said it would be two hours before the helicopter would arrive.
Heaslip was placed in a land ambulance and died en route to Toronto.
