The injunctions filed by Simcoe County and the Council of Canadians in the fight over Site 41 in Tiny Township will be ruled on later next month.
Council of Canadians Chair Maude Barlow says the judge will wait until August 13th to make a decision on both documents.
But Barlow adds the temporary injunction by Simcoe County is still in place, which means construction can start up again before the next court date.
She says construction hasn’t started yet since the last temporary injunction, however, so Barlow says we’ll have to wait and see it it starts up soon.
She says they are arguing that County Council missed an important step in the process of constructing the cell itself.
The council is demanding construction of the site be halted, and Barlow says that staff was required to come back for further permission.
She says it’s understandable that the judge needs more time to decide, because both sides have complicated arguments.
But Barlow adds they would much rather have Simcoe County council make a political decision over the site, as opposed to going the legal route.
The Council of Canadians wants a 1 year moratorium, and Barlow says Simcoe can end the legal process right now by doing the right thing.
She says the political pressure needs to mount now, and people need to talk to their county councillors
